"Mark Towle asked me several times if I still had my signed first contract as things got progressively worse between us. I would never answer him so he likely assumed I had lost my original contract. Mark Towle filed a fraudulent contract that included a complete escape clause within his complaint as well as a total non-disclosure clause. I believe he attempted this deception on purpose hoping that I had lost my contracts and that the court would accept his version in lieu of us having no originals. Mark Towle also filed an altered second contract hoping that the court would accept his altered contract that increased the number of pages I was required to complete, but I nailed him for both deceptions! My original contracts safely filed securely within the Jefferson County Circuit Court were the ones accepted by the California Court for Mark Towle's trial"
Once Scott Lee notified the Court, of Mark Towle's deceptions, Mark Towle claimed they were filed by mistake. Mark Towle claimed that the fraudulent contract he filed was a first draft of the contract Scott Lee and he eventually signed. It was nothing of the sort. Scott Lee authored the first and second contracts himself and no contract of Mark Towle's was used as any first draft.
The first contract was modeled off the contract Scott was nearly going to sign with Mark Racop. Scott authored the first contract by emulating his contract with Mark Racop and making changes that he and Towle agreed to. Mark Towle's so called drafted fake contract had nothing to do with anything but attempting to deceive the court and taking everything he could from Scott.
Here is the fraudulent contract Mark Towle filed and swore to be a true actual copy of Scott Lee and Mark Towle's original agreement. If you read the bottom paragraph you will see a total escape clause that benefits only Mark Towle. If anyone were to sign this contract they would release Mark Towle and his associates from any responsibility for anything and everything. If the court had accepted this contract as rightful and correct, Mark simply could have claimed he was free and clear of any money owed, product not delivered, and damages owed. Evidently this IS representative of Mark Towel's contract he tries to get people to sign. His escape clause was found exactly the same in another person's contract that lost $7,000 to Mark Towle and chose to walk away without their money rather than go into litigation, possibly because of this escape clause. Mark Towle also had within this fraudulent contract a non-disclosure clause which Mark Towle could have attempted to utilize in Court to seek damages from Scott Lee.

Now BattyLeaks is going to show you a section from the 2nd contract where Mark Towle altered the Contract with his own hand to add an additional 5 pages to be required for Scott to complete under the 2nd Contract. Mark Towle again stated this was just an error but still, he swore this page to be an accurate copy of the actual contract between parties. According to the hand written alterations on this section of the contract, Scott was obligated to complete 18 HTML pages.
The contract actually only required Scott to deliver 13 HTML pages before Mark Towle added another 5 with his handwriting and swore to the Court that this altered contract was an accurate copy. In the end, Scott had completed 15 main HTML pages and over 41 additional insert HTML pages to fill the contract breaching and expanding needs Mark Towle demanded for increased content and functionality. Those demands were breaches of the 2nd contract. Scott was coerced to complete far more than he ever agreed to by contract, had completed the exceeding demands forced on him when Mark Towle quit the project and sent a letter of coercion from his attorney attempting to coerce $22,750 from Scott without any valid reason to do so.

Mark Towle has claimed many things, that he made these errors after being caught. He also claimed his attorney Wm. Greg Bennett. was incompetent and made these errors, however we at BattyLeaks do not agree.
It is clear that Mark Towle was again attempting another Bait and Switch and this one if it had not been challenged could have given Mark Towle the win and devastated Scott Lee's life. It is not believable that any Attorney could have actually submitted the first contract that was not signed by either party and on top of that not notarized either. Wm. Greg Bennett is a seasoned experienced Attorney. We believe that it is highly more likely that Mark Towle was intentionally attempting to win his case against Scott Lee by defrauding the Superior Court of California for the County of Riverside and hoping that Scott Lee would not know how to defend it or miss it entirely.
It is also hard to believe that Mark Towle could have made these mistakes because Scott Lee had included his actual original contracts that he had within his original complaint back in West Virginia and served Mark Towle copies of them months prior to this same attorney. Therefore, there was absolutely no reasonable explanation as to how this fraudulent first contract even made it into the hands of WM. Greg Bennett in the first place and also no believable explanation as to why Wm. Greg Bennett didn't just copy Mark Towle's original Contracts.
Both Mark Towle and Scott Lee had their own set of original Contracts that were signed and notarized. Mark Towle had his and Scott Lee also kept a set of originals. There is no believable explanation as to why Mark Towle would have presented any unsigned contracts to his Attorney. It is is even more unbelievable that any seasoned Attorney would have presented any unsigned contract as genuine to the Superior court unless it had been a pre-planned scheme to defeat Scott Lee through deceptive planning and execution.
Only a fool would believe that Mark Towle did not intentionally submit these fraudulent contracts to the Court and swear them to be true without knowing full well they were faulty. No one would or could believe anything different. His motives are clear and his methods are also clear. The only thing he didn't count on was Scott Lee not being stupid and being able to litigate the truth into the procedings.
But Wait there's More!
Mark Towle had been caught filing a fraudulent contract and and altered contract, so what does he do next? Mark Towle decided to say that he never had any original contracts in the first place and that Scott Lee was the only person that ever held any original contracts.
Again, Mark Towle the Captain of absurd bait and switches SWITCHED AGAIN!
Mark Towle took this new stance and put more blatant lies into the public record!
If the contract Mark Towle filed in his complaint against Scott Lee were not his own original that had as Scott Lee swore to the court, they should be identical correct? Here we have even more proof that the guy that thinks too much of himself made yet another mistake. Tole obviously forgot to compare the signature pages of Scott's submitted copy and Mark Towle's submitted copy. Towle was caught again making false statements to the Superior Court of California! If Mark couldn't make a good story for the court Mark Towle was going to fake a good Story to the Court!

This proves without any doubt that Mark Towle's statements to the Superior Court that he never held original contracts was a LIE! Below is a 50% transparent overlay of the submitted 2nd contracts. If Mark Towle had never been given a set of original contracts from Scott Lee the only signature page he could possibly have a copy of would have been a direct and exact dupicate of Scott Lee's set of Contracts, but it's NOT!
Scott Lee prepared 2 identical contracts for each agreement, the agreement created and signed from 2007 and then again from 2010. Scott Lee went to his bank in West Virginia and for each agreement, he signed two copies and notorized them both. He then sent Mark Towle both contracts in California. Mark Towle signed and notorized both copies and sent one copy back to Scott Lee and kept a set of originals for himself. Both Mark Towle and Scott Lee had a complete set of original notorized Contracts for the first agareement as well as the second. Mark Towle had again been caught giving false testimony to the Superior Court of California by testifying that he believed he had never held correct original contracts! Mark Towle is a PROVEN LIAR!
